Terms of Service
These Terms of Service (“Terms”) govern your access to and use of Nook, a voice-assistant application for Windows, and related websites and services (collectively, the “Service”). By downloading, installing, or using Nook, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to create an account and purchase a subscription. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf and is responsible for your account and any charges.
2. Your account
You are responsible for keeping your account credentials secure and for all activity under your account. Provide accurate information when you sign up, and keep it current. Notify us promptly of any unauthorized use.
3. The Service
Nook lets you control your Windows PC and get answers by voice or text. Some commands run locally on your device; others (“AI commands”) are processed by third-party AI providers. Access to the Service requires an active paid subscription. Features may change, improve, or be discontinued over time.
4. Subscriptions, billing, and cancellation
- Plans and pricing. Nook is offered as monthly subscription plans (for example Lite, Pro, and Premium) at the prices shown at checkout.
- Recurring billing. Subscriptions renew automatically each month and your payment method is charged until you cancel. Payments are processed by Stripe.
- Cancellation. You may cancel anytime from within the app or the customer billing portal. Cancellation stops future charges; your access continues until the end of the current billing period.
- Refunds. Except where required by law, payments are non-refundable. Cancel before your next renewal to avoid further charges.
- Price changes. We may change prices; we will give reasonable notice before a change affects your renewals.
5. Acceptable use
You agree not to: use the Service for anything illegal or harmful; attempt to disrupt, overload, or gain unauthorized access to the Service; resell or redistribute the Service without permission; or reverse engineer, decompile, or attempt to extract source code or credentials except to the extent the law permits. You are responsible for how you use commands that control your computer.
6. AI output and third-party services
AI features rely on third-party providers (including Anthropic and, for voice, ElevenLabs). AI responses may be inaccurate, incomplete, or unsuitable for your situation, and are not professional, legal, medical, or financial advice. Verify important information before relying on it. Your use of third-party services may also be subject to their terms.
7. Intellectual property
Nook, including its software, branding, and content, is owned by us and protected by law. We grant you a limited, non-exclusive, non-transferable license to install and use Nook for your personal or internal business use while your subscription is active. You retain rights to your own content.
8. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim.
10. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination will survive.
11. Changes to these Terms
We may update these Terms as the Service evolves. We will update the “Last updated” date and, for material changes, provide reasonable notice in the app or by email. Continued use after changes take effect means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Texas for any dispute not subject to arbitration or small-claims resolution.
